Vendor Terms & Conditions

Vendor Registration

Vendors must complete registration accurately and truthfully. You are responsible for complying with all applicable laws, including food safety regulations, licensing requirements, and tax obligations. BurnerMarket reserves the right to reject or terminate any vendor account at its discretion.

Product Listings

All product listings must include accurate descriptions, correct pricing, and up-to-date availability. Listings must meet BurnerMarket's quality and labelling standards as set out in the Vendor Policy. False, misleading, or non-compliant listings may result in removal or account suspension.

Order Fulfilment

BurnerMarket manages the storage, packing, and shipping of all vendor products from our warehouse. Vendors are responsible for:

• Ensuring inventory levels are accurate and kept up to date.
• Delivering stock to BurnerMarket's warehouse in good condition and on agreed timelines.
• Notifying BurnerMarket promptly of any supply issues that may affect fulfilment.

Returns and Refunds

BurnerMarket manages all customer returns and refund requests on behalf of vendors. Where a return arises from a product defect, quality issue, or inaccurate listing, the cost will be borne by the vendor and deducted from their next payment disbursement.

Payments

Vendor payments are disbursed within 14 working days of confirmed successful delivery to the customer. Payments are net of any applicable transaction fees, return adjustments, or deductions outlined in these Terms. BurnerMarket will provide a payment breakdown with each disbursement.

Vendor Responsibilities

Vendors agree to:

• Maintain consistent product quality in line with BurnerMarket's standards.
• Comply with all food safety regulations applicable to their products.
• Keep product information, pricing, and inventory accurate at all times.
• Respond to BurnerMarket communications within 2 business days.

Intellectual Property

Vendors retain ownership of all content they provide, including product names, images, and descriptions. By listing on BurnerMarket, vendors grant BurnerMarket a non-exclusive, royalty-free licence to use this content for marketing, promotional, and operational purposes on the platform and associated channels.

Account Suspension and Termination

BurnerMarket may suspend or terminate a vendor account for:

• Breach of these Terms or the Vendor Policy.
• Providing false or misleading information.
• Repeated quality or fulfilment failures.
• Any conduct that harms BurnerMarket's customers or reputation.

Where termination is not for cause, BurnerMarket will provide 30 days' written notice. Vendors wishing to leave the platform must also provide 30 days' written notice and remain responsible for fulfilling outstanding orders.

Liability and Indemnity

Vendors are solely responsible for the quality, safety, and legality of their products. Vendors agree to indemnify and hold BurnerMarket harmless against any claims, losses, or liabilities arising from their products, listings, or breach of these Terms.

Amendments

BurnerMarket may update these Terms at any time. Vendors will be notified of material changes at least 14 days before they take effect. Continued use of the platform after that date constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes that cannot be resolved through negotiation will be referred to the courts of Kenya.
